Fate of Christina album unsure

The fate of a Christina Aguilera album made when she was just 14 years old could be resolved by Wednesday afternoon.

"Just Be Free" was recorded by Aguilera's early producers, Platinum Recording, long before the pop diva signed her current deal with BMG.

Now Aguilera is suing Warlock Records -- the company that is planning to release "Just Be Free", along with Platinum Recordings and JFB Music -- for improper use of her name and likeness for their own profit.

"They [Warlock] do not have the right to distribute those early recordings," Aguilera's lawyer, Carla Christofferson, told AllPop, Tuesday from her Los Angeles office. "It was when she was 14 years old, and they have tried to distribute it using her name and likeness, which she hasn't authorized. They are not of the quality that she wants her fans to have in anything released with her authorization. She is against them being released."

Christofferson said Aguilera only recently became aware of the planned release of "Just Be Free".

"We found out when we found it on websites for pre-release," she said. "I actually found out from her mom."

Meanwhile, Adam Levy of Warlock Records told AllPop.com Tuesday that his label wants to be certain of exactly who owns the rights to the material on "Just Be Free" before his label releases the album.

"We think the world of Christina as an artist," said Levy from his New York office.

"The truth is, we went to court first because we wanted to seek a declaration as to who owned the rights before releasing it, because we take that stuff very seriously. We had gone into court about a week ago in New York, simply asking the court to render a judgment as to who actually owns these recordings and what the rights are and how they can be put out, and we are waiting the determination of that before we go forward or do anything else. In addition, we've been talking to Christina's management and legal counsel as to what we think the final position of this case will end up being, and I think we're pretty close to resolving the matter to everybody's satisfaction."

Levy went on to say that Warlock's team is scheduled to speak with Aguilera's camp on Wednesday, and he thinks the entire issue will be put to rest by then.

When informed of Levy's comments, Christofferson sounded hopeful about a possible resolution to the case -- although not quite as optimistic as Levy is.

"It might be [resolved Wednesday]," said Christofferson. "It would be nice if it is. Stranger things have happened. I would say there's a 50-50 chance it's resolved by (Wednesday) afternoon."

If Aguilera's camp gets their way, the songs on "Just Be Free" will never see the inside of a jewel case.

"None of those songs will be included on any of Christina's upcoming albums," reads a statement on her official site (www.christina-a.com). "'Just Be Free' is not even an authorized release and we urge you not to purchase it."

Meanwhile, fan sites and message boards are buzzing with speculation about Aguilera's unreleased material.

One fan posted questions about the album on Aguilera's official website:

"'Dreamy Eyes,' 'Too Beautiful for Words,' 'Just Be Free' and 'Don't Make Me Love You' - will these songs be included on the next Christina Aguilera English album or Christmas album?", reads one posting on www.christina-a.com.
